Agreement to Terms

By accessing and using this website or engaging our furniture-making services, you ("Customer", "you", "your") agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, please do not use our services.

These terms form a legally binding agreement between you and Vivopolish, a New Zealand-based furniture manufacturing business operating in Auckland. By placing an order or using our services, you acknowledge that you have read, understood, and agree to be bound by these terms.

About Our Business

Vivopolish is a New Zealand-registered business specialising in custom handmade furniture. We operate from our workshop at 268 Neilson Street, Onehunga, Auckland, and serve customers throughout New Zealand.

All our furniture is handcrafted in New Zealand using traditional woodworking techniques and sustainable materials sourced from certified suppliers.

Services

Vivopolish provides custom handmade furniture and related services including:

  • Design consultation and custom furniture design services
  • Handcrafted furniture commissions tailored to your specifications
  • Material consultation and timber selection guidance
  • Delivery and installation services throughout New Zealand
  • After-sales support and maintenance advice
  • Workshop visits and educational sessions (by appointment)

All services are provided in accordance with New Zealand consumer protection laws, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

Ordering Process

When you place an order for custom furniture:

  • We will provide detailed design drawings and specifications for your approval
  • You will receive a written quote valid for 30 days
  • Orders are confirmed upon receipt of your signed approval and deposit payment
  • All orders are subject to material availability and workshop capacity
  • We reserve the right to decline orders that do not align with our craftsmanship standards or ethical sourcing policies

Pricing and Payment

All prices are quoted in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) at the current rate of 15%, unless otherwise stated. Prices are valid only for the specific project quoted and may vary for similar projects due to material costs and design complexity.

Custom furniture orders require the following payment schedule:

  • 50% deposit upon design approval and order confirmation
  • 25% progress payment at the construction midpoint (when joinery is complete)
  • 25% balance due upon completion, before delivery

Payment methods accepted include:

  • Bank transfer to our New Zealand bank account (details provided on invoice)
  • Credit card payments (Visa, Mastercard) processed securely through New Zealand payment gateways
  • EFTPOS payments for in-person transactions at our workshop

All payments must be made in New Zealand Dollars. International customers are responsible for any currency conversion fees or bank charges.

Production Timeline

Production timelines are estimates provided in good faith based on current workshop capacity and material availability. Standard production times range from 8-16 weeks depending on:

  • Complexity of design and joinery requirements
  • Material sourcing and delivery times
  • Current workshop schedule and order queue
  • Seasonal variations in timber availability

While we strive to meet all delivery dates, delays may occur due to:

  • Unforeseen material sourcing challenges
  • Design modifications requested during production
  • Force majeure events (natural disasters, pandemics, supply chain disruptions)
  • Circumstances beyond our reasonable control

We will communicate any significant delays promptly and work with you to adjust timelines where possible. Delays do not constitute grounds for cancellation unless they exceed 12 weeks beyond the original estimated completion date.

Consumer Guarantees Act 1993

Under New Zealand's Consumer Guarantees Act 1993, our furniture comes with statutory guarantees that:

  • Goods are of acceptable quality (fit for purpose, safe, durable, and free from defects)
  • Goods match any description or sample provided
  • Goods are fit for any particular purpose you made known to us
  • Services are provided with reasonable care and skill
  • Services are fit for the particular purpose you made known to us

These statutory guarantees cannot be excluded and operate in addition to any warranties we provide.

Warranty

In addition to your rights under the Consumer Guarantees Act, all furniture comes with our lifetime structural warranty covering defects in materials and workmanship under normal use. This warranty:

  • Covers structural integrity of joints, frames, and load-bearing elements
  • Applies to defects in materials supplied by us
  • Covers workmanship errors in construction
  • Remains valid for the lifetime of the original purchaser

This warranty does not cover:

  • Normal wear and ageing of natural materials (wood grain changes, natural patina development)
  • Damage from misuse, accidents, or improper care
  • Changes due to environmental conditions (humidity, temperature variations, exposure to direct sunlight)
  • Unauthorised modifications, repairs, or alterations
  • Damage from moving or relocation without proper professional handling
  • Cosmetic changes that do not affect functionality

To make a warranty claim, contact us with photographs and details of the issue. We will inspect the piece and determine the appropriate remedy (repair, replacement, or refund) in accordance with New Zealand consumer law.

Cancellation and Refunds

Cancellation requests must be made in writing (email or letter) to our Onehunga address. Cancellation terms depend on the stage of production:

  • Before Production Begins: You may cancel and receive a refund of your deposit, less any design work completed (design fees may apply)
  • After Production Begins: Deposits are non-refundable as materials have been purchased and work has commenced. Cancellation may incur additional charges based on work completed and materials purchased
  • Near Completion: Full payment is required as the piece is substantially complete

Under the Consumer Guarantees Act, you may be entitled to a refund if goods are faulty or do not meet statutory guarantees, regardless of these cancellation terms.

Refunds will be processed within 14 business days using the original payment method, in accordance with New Zealand consumer protection standards.

Delivery

We offer delivery services throughout New Zealand:

  • Auckland Metro: Complimentary white-glove delivery and placement service
  • North Island: Delivery available at cost (quoted separately)
  • South Island: Delivery available at cost (quoted separately)

All furniture is fully insured during transit. Delivery dates are estimates and may vary due to weather, traffic, or other factors. We will contact you to arrange a convenient delivery time.

You are responsible for:

  • Ensuring access to the delivery location is clear and safe
  • Being present or arranging an authorised representative at the delivery time
  • Inspecting the furniture upon delivery and reporting any damage within 48 hours

Intellectual Property

All designs, images, text, logos, and content on this website are the intellectual property of Vivopolish and are protected by New Zealand copyright law. You may not:

  • Reproduce, copy, or distribute any content without written permission
  • Use our designs or images for commercial purposes
  • Create derivative works based on our designs

Custom designs created for your project remain your property for personal use, but we retain the right to photograph and display completed work in our portfolio and marketing materials (with your consent).

Website Use

When using our website, you agree to:

  • Use the website only for lawful purposes in accordance with New Zealand law
  • Not attempt to gain unauthorised access to our systems or data
  • Not transmit any viruses, malware, or harmful code
  • Not use automated systems to scrape or collect data from our website
  • Respect intellectual property rights and not infringe on our copyright

We reserve the right to restrict or terminate access to our website for users who violate these terms.

Limitation of Liability

To the maximum extent permitted by New Zealand law (including the Consumer Guarantees Act 1993 and Fair Trading Act 1986), our liability is limited as follows:

  • We are not liable for indirect, incidental, special, or consequential damages
  • Our total liability for any claim shall not exceed the purchase price of the furniture in question
  • We are not liable for delays caused by circumstances beyond our reasonable control
  • We are not liable for damage caused by misuse, improper care, or unauthorised modifications

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or other mandatory New Zealand consumer protection laws.

Dispute Resolution

If a dispute arises, we encourage direct communication to resolve the matter. If we cannot resolve a dispute:

  • You may contact the Commerce Commission (New Zealand's consumer protection agency)
  • You may seek mediation through the Disputes Tribunal (for claims under $30,000)
  • For larger disputes, you may pursue legal action in New Zealand courts

We are committed to fair resolution of disputes in accordance with New Zealand consumer protection standards.

Governing Law

These terms shall be governed by and construed in accordance with the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand, specifically the Auckland District Court or High Court of New Zealand as appropriate.

If any provision of these terms is found to be unenforceable under New Zealand law, the remaining provisions shall continue in full force and effect.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be notified by:

  • Posting the updated terms on this page with a new "Last Updated" date
  • Email notification to active customers for significant changes
  • Prominent notice on our website for substantial modifications

Your continued use of our services after changes are posted constitutes acceptance of the updated terms. If you do not agree with changes, you may cancel any pending orders in accordance with our cancellation policy.
